A Grant of letters of administration is simply the legal term given to the document that is issued when someone dies without a will. Once obtained the Deceased persons assets can be collected and the estate assets collected. It is issued to the administrator, who will typically be the next of kin, his or her role is very similar to that of an Executor. The Administrator will then have to distribute the estate according to the Intestacy Rules – these rules set out the order of entitlement of those persons entitled to the estate. The intestacy rules can be very straightforward when there is a surviving spouse or children of the Deceased, but they can be very complicateed when there a distant relative dies without leaving any children.
