Probate Duties : What is the difference between an Executor and an Administrator ?
Understanding the different terminology in probate can be very confusing as most of the phrases are not everyday terms. When someone has died the starting point in every case is whether the Deceased person left a Will. If this is the case the Will appoints someone to collect in and deal with the estate assets and liabilities. That person(s) is called an Executor. If the Deceased left no will, then the entitlement of the person(s) able to deal with estate assets are called the Administrators, and are subject to the Intestacy Rules.
