What is Probate ? and when it is needed

Probate isn’t the most common term and most people have little or no idea what it really means. Probate is the legal term given to the legal process that is followed after someone has died. It is typically, undertaken by the Executor when a will exists or by an Administrator ( normally the next of kin ) when there is no will. It ends with the Probate Court called the Probate Registry, issuing a legal document called a Grant of Probate ( when there is a will ) or a Grant of letters of administration ( when there is no will ). It is this document commonly referred to as the Grant, that is then sent off to banks and building societies for assets to be collected enabling the estate to be distributed.
